These terms govern your use of MyProperti, operated by [LEGAL ENTITY NAME], registered in India at [REGISTERED ADDRESS]. By creating an account you agree to them.
1. What MyProperti does
MyProperti is a software tool that helps real estate agents create, launch and manage advertising campaigns on third-party platforms, and manage the enquiries those campaigns produce. We are a software provider, not an advertising agency and not a real estate broker. We do not take part in property transactions.
2. Your account
You must be at least 18 and legally able to enter a contract. You are responsible for keeping your login details secure and for everything done under your account. Tell us at once if you think someone else has access.
One subscription covers one agent, except on the Agency plan where the stated number of logins applies. Sharing a single login across multiple agents is not permitted.
3. Advertising spend
Your ad spend is billed by the platforms, not by us. When you run a campaign, Meta, Google or another platform charges your own payment method directly. We never collect, hold or mark up your advertising budget. Our subscription fee is separate and covers use of the software only.
You are responsible for the budgets you set. We show projected figures during campaign setup — these are estimates based on typical performance and are not a guarantee of results, cost per enquiry, or enquiry volume.
4. Third-party platforms
MyProperti works by connecting to platforms including Meta, Google and WhatsApp. Your use of those platforms is governed by their own terms and advertising policies, and you remain responsible for complying with them. We cannot control their decisions: a platform may reject your ad, suspend your ad account, or change its rules at any time. Where that happens we will tell you what we know, but we are not liable for it.
5. Content and advertising standards
You are responsible for the accuracy of everything you advertise, including prices, availability, approvals and RERA registration where applicable. Our AI produces draft ad copy as a starting point; you review and approve every advertisement before it goes live, and you are responsible for what it says.
You must not use MyProperti to advertise property you are not authorised to market, to make misleading claims, or to run advertising that breaks Indian law or the advertising policies of the platform in question.
6. Enquiry data
Enquiries generated through your campaigns belong to you. You may export them at any time. You are responsible for handling that data lawfully, including honouring requests from enquirers to be contacted no further, and for complying with TRAI regulations on commercial communication where they apply to you.
You must not sell, share or re-market enquiry data collected through MyProperti to other agents or third parties.
7. Subscription and payment
Plans are billed monthly in advance. Free trials run for the stated period and require no card. If you do not subscribe at the end of a trial, your account moves to read-only and your data is retained for 90 days.
You may cancel at any time from Settings. Cancellation takes effect at the end of the current billing period. We do not refund part-months. Campaigns you have already launched continue to run in your own ad account and can be managed directly on the platform.
Where a commission applies to closed deals sourced through MyProperti, the rate is shown in your account and is agreed before it takes effect.
8. Availability
We aim to keep MyProperti available at all times but do not guarantee uninterrupted service. We may need to take the service down for maintenance, and third-party platforms or APIs may be unavailable for reasons outside our control.
9. Our liability
MyProperti is provided as-is. We do not guarantee any particular number of enquiries, cost per enquiry, or sales. To the extent the law allows, our total liability to you in any twelve-month period is limited to the subscription fees you paid us in that period. We are not liable for lost profits, lost deals, or indirect losses.
10. Ending the agreement
You may close your account at any time. We may suspend or close your account if you break these terms, if you use the service to run unlawful or misleading advertising, or if payment fails and is not resolved. Where we can, we will give you notice and a chance to put things right first.
11. Changes to these terms
We may update these terms. We will post changes here and email you at least 14 days before material changes take effect. Continuing to use the service after that means you accept the new terms.
12. Governing law
These terms are governed by the laws of India. Courts at [CITY], Haryana have exclusive jurisdiction over any dispute.
